Justice Binta Nyako Quash 6 Charges Against Nnamdi Kanu; Declares IPOB Legal


The Federal High Court sitting in Abuja has struck out six of eleven count charges leveled against Nnamdi and co-defendants.

The presiding judge, Binta Nyako stated that the charges put forward by the Nigeria government against the defendants lacks merit, as the federal government has failed to produce any veritable evidence to substantiate the charges.

The judge however stated that 5 of the charges still holds and will be deliberated upon by the court.

“I have three separate applications before me, except that of the third defendants,” judge Binta Nyako read in her ruling.

I hereby strike out, Count 3,5,7,9,10 and 11. But, Count 1,2,4,6 and 8 stands.

In count eleven, Justice Binta said claims by the prosecution (Nigeria) that the defendants are researching how to make improvised explosive devices cannot hold waters, because there is no proof that they were doing it.

On count five which bothers on belonging to an illegal organization, Justice Nyako also ruled that nothing was placed before the court to indicate that it is an illegal organisation.

On count seven which bothers on importation of radio transmission equipment ,Justice Nyako also says that the prosecution did not furnish the court with any proof to suggest that the importation was illegal

She also ruled that IPOB does not belong to an unlawful society, “I will also put it before the court that, the only evidence the prosecutor have provided is, the statement the defendant made while broadcasting,”

“The prosecution have not placed any evidence before the court, to back up the charges that
(1) IPOB is an unlawful society, though is not registered in Nigeria, the judge stated.

Meanwhile, She retained five other counts bothering on treason, terrorism and possession of arms.

Finally, the court was adjourned to 20th March 2017, awaiting the total discount off all charges leveled against Mazi Nnamdi Kanu. As they will be re-arraigned again in the remaining charges.
